ASSESSMENT OF REGULATORY CONSTRAINTS ON TECHNOLOGY DISSEMINATION IN TANZANIA’S MINING INDUSTRY: A CRITICAL ANALYSIS

Tanzania’s mining industry attracts substantial investment and provides an important platform for technological development. This paper examines the legal and regulatory challenges affecting technology dissemination in Tanzania’s mining industry, with particular emphasis on the adequacy, clarity, implementation and enforcement of existing legal obligations. The analysis focuses principally on the Mining Act, the Mining (Local Content) Regulations, and related investment and natural-resource legislation. The paper argues that the principal challenge is therefore not the complete absence of legal provisions, but the adequacy, specificity and enforceability of the mechanisms through which those provisions are translated into measurable technological capabilities. It recommends strengthening statutory standards for technology transfer, establishing measurable performance indicators and reporting requirements, improving institutional coordination and enforcement, and developing stronger linkages among mining companies, local enterprises, universities and technical institutions.
